Disclaimer

Damage caused by the owner’s negligence, such as gasoline and oil spills, dents from chairs, ladders, tree roots, tire marks, etc., is not covered. Pavement failure due to subsoil sinkage is not guaranteed. After completion of the contracted work, Delia Paving & Interlocking Ltd. will not be responsible for any damage to paved surfaces caused by heavy vehicles, heavily loaded vehicles, or equipment/machinery.

The homeowner is legally obligated to Delia Paving & Interlocking Ltd. upon the preparation of any kind of work, whether it be asphalt or bricks. The paving will remain the property of Delia Paving & Interlocking Ltd. until the final payment has been received at our office. The paving can be reclaimed without permission from the assignee if payments are not made as agreed upon in this contract. Delia Paving & Interlocking Ltd. is not responsible for damage to existing driveway curbs, sidewalks, garage floors, surrounding landscape, sod, shrubs, trees, etc.

Delia Paving & Interlocking Ltd. is not responsible for any foundation leaks, both prior to and after the completion of driveways. Delia Paving & Interlocking Ltd. is not responsible for delays due to transportation or weather conditions. Delia Paving & Interlocking Ltd. is not responsible for broken water box shut-off valves. Any concrete work performed by Delia Paving & Interlocking Ltd. is not guaranteed against stress cracks.

A minimum charge of $100 will apply to any NSF or stop-payment checks for inconvenience. Homeowners should notify Delia Paving & Interlocking Ltd. of any garage before commencing work. It is the responsibility of the homeowner to notify Delia Paving & Interlocking Ltd. of any existing property damage before commencing work (e.g., dented garage doors or broken bricks, etc.). A full inspection of the work and surrounding property is to take place within 24 hours by the owner.

Any concerns should be reported immediately. Any complaints must be submitted in writing, and a photocopy of the contract should be sent to our office. Any repair work will only be conducted through burning, saw cuts, and patching in the specified repair area. Delia Paving & Interlocking Ltd. is not responsible for locating services such as hydro, gas, and cable, etc.

Delia Paving & Interlocking Ltd. is to receive full payment at the office on C.O.D. terms. If payment is not received at the office, the project will remain the property of Delia Paving & Interlocking Ltd., and the materials/labor can be reclaimed at any time without permission from the client if payments are not made as agreed upon in this contract. Deposits are nonrefundable unless otherwise agreed upon. A 2% interest charge per month will apply if the balance is not received upon completion.
